Publishing: Editorial and Production Costs

Production costs are an essential aspect of bringing a well-made book to market. Every writer pays for quality in the short run or for shortcuts in the long run. Every publisher must pay for ink and paper, and (I hope) for editing and design. Editors and designers are part of the essential supply chain that results in ready-to-retail books. The professionals who make their living providing printing, cover design, editing, typesetting, and binding can quite reasonably be expected to earn a profit.

If these costs aren’t clearly stated, don’t pretend your “publisher” has some magical ability to “make them go away.” Anyone claiming to be your publisher—even a legitimate operator—expects to pay these bills. Knowing where that money comes from is important.

     Publishing: Distribution and Sales Costs

Additional costs include shipping, distribution, and seller commissions (which usually run half of cover price). These costs occur after your book is made available to the public and an order is placed.

Do you know what it costs to sell one copy of your book? Do the math. Subtract your editorial and production costs from what you have left after the seller’s commission is paid. If you don’t know what it costs to print, ship, and sell a book, you are not in control of your publishing business.

David L. Amkraut is a Los Angeles-based Attorney at law. His practice emphasizes cutting-edge Internet-related copyright matters. Among other cases, he was attorney for the plaintiffs in Louder v. CompuServe, a class-action case involving unauthorized publication of 930 photographs of models by the 2nd-largest Internet Service Provider in the world. He also served as counsel in KNB v. Matthews, an important case defining the relationship between copyright and the “Right of Publicity” in still photographs. Law Offices of David L. Really, when you strip away the fancy language, Fair Use is a pretty sensible concept. It gives “breathing room” to the First Amendment and tries to strike a balance between protecting the copyright owner’s property rights, and encouraging valuable activities such as scholarship and public discussion. Fair Use comes down to whether the use is “fair” and should be allowed.

You’re a college professor as well as a writer or self–publisher. You gather full chapters from several books, and have them copied, printed, and bound to create your course’s required readings. The students buy the compilation at a copying service company. You, the professor, get a lucrative kickback. The owners of copyright in the works you copied get nothing. You and the copying service get sued. You claim Fair Use.

Analysis: You fail on Factor 1, because you are making money, not just using the copied work for education. Factor 2 is unfavorable to you. You argue like crazy but are wrong on Factors 3 and 4. By the way, this scenario is based on an actual case, and defendants lost. The Court may have also been disgusted with defendants’ “dirty hands,” involving the copying services and bookstores paying kickbacks or commissions to the professors. You lose. Not Fair Use.

Celebrities were at an advantage competing for book deals. “It seems as though if you’re a celebrity you can just express the idea you would like to do a book – like [radio DJ] Christian O’Connell did on Twitter – and you will get a deal. You still have to pitch your books.

Authors’ incomes have fallen dramatically over the past 15 years, with many forced to give up writing full-time and find alternative employment to prop up earnings. According to data published by Queen Mary University for the Authors Licensing and Collecting Agency in 2014, only 10% of professional authors make £60,000 or more a year from writing, while the bottom 50% of authors earn less than £10,500. The bottom 50% of authors account for only 7% of the income earned by all writers put together.

While many authors have moved into teaching creative writing courses in tertiary education to shore up their income, others, such as Dan Rhodes, have been forced to take jobs outside the literary world; the Timoleon Vieta Come Home author now works as a postman.
